| dc.description.abstract | Türk anayasal sistemi, Cumhuriyetin kuruluşundan itibaren Cumhurbaşkanının Türkiye Büyük Millet Meclisi tarafından seçilmesini öngörmüştür. 2007 yılında 10. Cumhurbaşkanı Ahmet Necdet Sezer’in görev süresinin dolmasının ardından Türkiye Büyük Millet Meclisi Genel Kurulunda yapılan Cumhurbaşkanlığı seçimi ile ilgili Anayasa Mahkemesi’nin verdiği meşhur 367 kararı siyasi ve hukuki bir kriz doğurmuştur. Hukuki anlamda izahı mümkün olmayan bu karara Adalet ve Kalkınma Partisi, Cumhurbaşkanının doğrudan halk tarafından seçilmesini öngören bir anayasa değişiklik paketi ile cevap vermiştir. Halkoylaması ile kabul edilen bu anayasa değişikliğinin ardından Cumhurbaşkanının doğrudan halk tarafından seçilmesi esasına geçilmiş ve ayrıntılı bir seçim hukuku süreci ortaya çıkmıştır. Cumhurbaşkanının halk tarafından seçilmesini öngören ilgili anayasa maddesi seçimle ilgili usul ve esasların kanun tarafından düzenlenmesi ilkesini benimsemiştir. 19.01.2012 tarih ve 6271 sayılı Cumhurbaşkanı Seçim Kanunu, Cumhurbaşkanı adaylarının seçim gelir ve giderlerine ilişkin usul ve esasları düzenlemiş olup bunların denetlenmesi görevini Yüksek Seçim Kuruluna vermiştir. Çalışmada Yüksek Seçim Kurulunun 2014, 2018, 2023 yıllarında gerçekleşen Cumhurbaşkanlığı seçimlerinde verdiği kararlar ışığında seçim gelir ve giderlerinin denetimi konusu incelenmiştir. | |
| dc.description.abstract | Since the establishment of the Republic, the Turkish constitutional system has stipulated that the President will be elected by the Grand National Assembly of Türkiye. The famous 367 decision of the Constitutional Court regarding the Presidential election held at the General Assembly of the Grand National Assembly of Türkiye, in 2007, after the term of office of the 10th President Ahmet Necdet Sezer expired, created a political and legal crisis. The Justice and Development Party responded to this decision, which cannot be explained in legal terms, with a constitutional amendment package that provides for the President to be directly elected by the people. With this constitutional amendment, which was accepted by referendum, the principle of direct election of the President by the people was introduced and a detailed election law process emerged. The relevant constitutional article, which provides for the President to be elected by the people, adopts the principle that the procedures and principles regarding the election are regulated by law. Presidential Election Law No. 6271 dated 19.01.2012 regulates the procedures and principles regarding the election income and expenses of the Presidential candidates and assigns the duty of auditing them to the Supreme Election Council. In the study, the issue of auditing election revenues and expenses was examined in the light of the decisions made by the Supreme Election Council regarding election revenues and expenses during the Presidential election process held in 2014, 2018 and 2023. | |
